The general terms and conditions of sale apply to all offers made by, orders placed by, deliveries made by and payments made to Pieman Bakery. It is only possible to deviate from these conditions if this is done in advance in writing and explicitly on points, whereby the other provisions remain fully in force. By accepting an offer or placing an order, the customer of Pieman Bakery indicates to accept these conditions.
Offers and prices
Offers by and prices from Pieman Bakery are without obligation. Pieman Bakery accepts no liability for typographical or printing errors. Pieman Bakery reserves the right to immediately pass on changes in cost prices, exchange rates or (legal) regulations. All applicable prices are always including VAT and excluding order and shipping costs, any taxes or other levies, unless stated otherwise or agreed in writing.
By placing an order, the agreement is a fact. Pieman Bakery reserves the right to refuse orders without stating a reason, or to attach conditions thereto.
Pieman Bakery will always strive for fast delivery of the ordered. However, specified delivery times are only indicative. Exceeding any delivery period does not give the customer the right to compensation or the right to terminate the agreement referred to in Article 3. All rights and claims, as stipulated in these conditions, also apply to third parties engaged by Pieman Bakery for the delivery.
The customer is obliged to inspect the goods immediately after delivery or delivery. Complaints must be submitted to Pieman Bakery in writing – or by e-mail – on pain of cancellation of all rights within one day after the time of delivery of goods, stating the nature of the complaints regarding the delivered goods. goods. Manco’s and visible defects on delivery must, however, be reported to Pieman Bakery within 4 hours of delivery, on pain of forfeiting all rights ensuing therefrom.
At Pieman Bakery, the customer meets the obligation that arises from the agreement referred to in point orders, by means of prepayment through Ideal. In the event that Pieman Bakery sends an invoice, payment must take place within the period of 7 calendar days, without settlement, discount and / or suspension. The date of payment is the date of crediting the bank account of Pieman Bakery.
Complaints, warranty and return goods
The period for complaints regarding delivered goods is limited to the provisions of the third paragraph under deliveries. If it has been demonstrated that the products do not comply with the agreement, Pieman Bakery has the option of replacing the products in question with new products or returning the invoice value thereof. The warranty period for delivered products is the shelf life, which is guaranteed by Pieman Bakery. Replacement will take place free of charge within this period.
Transfer of risk and ownership
The risk of the delivery passes from Pieman Bakery to the customer as soon as delivery has taken place. However, ownership will only pass if the customer has fulfilled all his obligations referred to in point 1 of the payment.
If the customer submits an address to Pieman Bakery, Pieman Bakery is entitled to send all orders to that address while retaining all rights as referred to in the payment item. Pieman Bakery is entitled to use the e-mail address of the customer to send periodic newsletters and other automated and / or personal e-mails. The customer can cancel this membership at any time by unsubscribing in one of the emails.
